Need more space?
If you need more land for a home or garden extension, or to expand your business, and there is land adjoining your property which is owned by the council, you can enquire about the possibility of purchasing the land by filling in the online enquiry form.
In addition to the purchase price, the property transaction will attract further costs.
Advertising fees If the council deems the land is open space, the potential loss must be publicised in accordance with section 123(2A) of the Local Government Act 1972. This fee is currently £600 and must be paid in advance of advertising and is non-refundable.
External surveyor fees These will vary on a case-by-case basis as the services of the external surveyor are procured via our electronic tendering system. You will be advised of the cost and, if you wish to proceed, the external surveyor fee becomes payable in advance of formal instruction. Once the external surveyor is appointed, this fee becomes non-refundable. Previous small land disposals have attracted external surveyor fees of around £700.
Legal fees You will be liable to pay the council's legal fees for the transaction which are currently around £800 plus disbursements. If you do not appoint a solicitor to act on your behalf, these fees will be payable and collected in advance by the legal team.

Each enquiry to purchase council owned land is investigated fully in consultation with other council departments and there is no guarantee that your request will be successful. There is no option to appeal a decision as this process is not a statutory function.
No fees are payable until a decision to consider a disposal is made by the council and we receive your confirmation to proceed. All disposals are subject to acceptance of terms and requisite approvals.
Sandwell Council is unable to provide an estimate of the value of the land prior to receipt of the valuation report from the external surveyor. The valuation report remains for the sole use of Sandwell MBC and will not be shared.
