Sole tenancy request FAQ's

How can I apply? Log onto my.sandwell.gov.uk and complete the contact us about your housing form

What is a sole tenancy request? A sole tenancy request is when a joint tenant requests that either they or the other person be removed from the tenancy agreement

How long does it take? The 28 day notice period starts from the closest Monday on or after the request date and all investigations will be complete during this time

Can a sole tenancy be refused? Yes, a sole tenancy can be refused for the following reasons

  • the property is too big for the remaining tenant (under occupied) 
  • outstanding possession orders 
  • anti-social behaviour 
  • unacceptable condition of property and/or garden 
  • rent arrears, including court costs and recharges 

What happens if the request is approved? The remaining sole tenant will be required to sign a new tenancy agreement and will be advised of their responsibilities

What happens if the request is refused? The remaining sole tenant will be required to move to alternative accommodation and support will be provided to assist with this  

What happens if I change my mind? If you change your mind during the process you should notify the officer dealing with your request in writing immediately. Once notice has been received to terminate a tenancy it cannot be reinstated or retracted and the tenancy will end

If both parties would like to apply for a joint tenancy this can be considered, however a sole tenancy may be more appropriate to prevent a similar situation in the future

If neither party is eligible for the property a use and occupation account will be set up whilst alternative accommodation is found
