What is an assignment? An assignment is the transfer of a tenancy from the tenant to another person
Who can request to assign their tenancy? Secure tenants have the right to assign their tenancy
How can a tenancy be assigned? Tenancies can be assigned by way of mutual exchange, following a court order in some relationship breakdown cases and to a member of the tenants’ family who would be a successor
Which family members can a tenancy be assigned to? Tenancies can be assigned to family members who would be a successor.
For tenancies that began before 1st April 2012, a tenant can assign their tenancy to one of the following:
- Husband, wife, civil partner if they live with them
- Another member of the tenant’s family if they have lived there for the last 12 months. These family members include someone who has been living with them as husband, wife or civil partner, parent, grandparent, child, grandchild, sibling, aunt, uncle, niece and nephew. Step-relations and half-relations are included
For tenancies that began after 1st April 2012, a tenant can assign their property to one of the following:
- Husband, wife, civil partner or someone who has been living them as husband, wife or civil partner.
How many times can a tenancy be assigned? A tenancy can only be assigned once. When a tenancy is assigned it is classed as a succession and no further successions will take place in the event of the tenants’ death.
What proof is required? The family member you are requesting to assign the tenancy to will need to provide:
- photo identification
- proof of address dated over 12 months
How long does it take? Following the receipt of a request and all relevant proofs a timely decision will be made.
